YS Jagan: Important developments in the case of cancellation of bail of former CM Jagan, Supreme Court Registry changed the court again
YS Jagan: There has been a significant development in the Supreme Court in the petitions filed by Deputy Speaker Raghuram Krishnaraju to cancel the bail of former CM Jaganmohan Reddy and transfer the hearing of the cases. Once again the Supreme Court Registry has changed the bench hearing this case. The Supreme Court Registry has changed the bench of Justice Abhay S Oka and Justice Pankaj Mittal to the bench of Justice BV Nagarathna and Justice Satish Chandrasharma. First the bench of CJI Justice Sanjeev Khanna and Justice Sanjay Kumar heard the case, but Justice Sanjay Kumar recused himself from hearing the case. With this the petition was transferred to the bench of Justice Abhay S Oka and Justice Pankaj Mittal.
Raghuram’s lawyer Balaji Srinivasan argued that the trial has not progressed even a single step for the last twelve years. It is said that not a single discharge application has been disposed of in the last ten years. Raghuram’s lawyer argued that the CBI and the accused have conspired in this case and not a single step has been taken. He reminded that five judges were transferred after hearing arguments on the discharge petitions and without issuing any judgment on them. Once it is an accident, second time some other reason can be considered, but even for the fifth time… it is being said that there must be some conspiracy aspect in it.
He said that there is a hidden conspiracy in the transfer without final decision on even a single discharge application. To this end, Raghuram’s lawyer said that they had filed a petition seeking transfer of the case, but now they are not seeking either. The lawyer clarified that the Supreme Court had said in the last hearing that transfer was not possible and now they were only saying that the case should be completely monitored.
On behalf of the investigating agency CBI, the lawyer said that an affidavit has been filed in which the details and current status of CBI cases have been given. Jaganmohan Reddy’s lawyer Mukul Rohatgi said that the case is being monitored by the High Court and the matter is still pending there. Raghuram’s lawyer said that Jaganmohan Reddy has been on bail for the last ten years and the trial is being delayed despite clear orders from the Supreme Court and the High Court.
CBI counsel sought some time to present arguments in the case. The CBI counsel sought adjournment as the Additional Solicitor General was hearing arguments in another case. The bench of Justice BV Nagarathna and Justice Satish Chandrasharma made it clear that the investigation will be conducted next Monday. Solicitor General Tushar Mehta told the bench that if the Additional Solicitor General does not come next Monday, he will present the arguments himself. The court agreed to this. Due to this the hearing of the case was postponed.
But the court is intent on rejecting this petition. The Supreme Court bench has made it clear that the trial can be changed only in the last hearing. In such a situation, if the petition is rejected then former CM YS Jaganmohan Reddy will get relief. The Supreme Court bench will clarify this in the next hearing.
